What is a Notice of Default?

A Notice of Default is an official document that is filed with the County Recorder's office when a borrower has missed at least 3 consecutive mortgage payments. The lender will hire a Trustee (an attorney or title company) to act on their behalf.

Once the Notice of Default (NOD) has been filed, your financial problems become public record. You will be contacted by all kinds of people. Investors wanting to take advantage of the equity you have built up in your home, attorney's wanting to help you file bankruptcy and real estate agents wanting to help you sell your home.
